These Terms of Service (“Terms”) govern your access to and use of the DocQube platform (“the Platform”) operated by Maskan Technologies Private Limited (“we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
Your access to DocQube is provisioned by your organization, which has entered into a separate Master Service Agreement (“MSA”) with us. These Terms supplement that agreement by governing your individual conduct as a user. In the event of any conflict between these Terms and the MSA between us and your organization, the MSA shall prevail.
1. Account and Access
- 1.1. Your account is created by your organization’s administrator. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- 1.2. You must immediately notify your organization’s administrator and us at support@docqube.com if you suspect unauthorized access to your account.
- 1.3. Your password must be at least 12 characters and include at least one uppercase letter, one digit, and one special character.
- 1.4. We reserve the right to suspend or deactivate your account if we reasonably believe it has been compromised or is being used in violation of these Terms.
2. Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You shall not:
- (a) Upload, store, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
- (b) Upload files containing malware, viruses, or any harmful code. All uploads are scanned by our antivirus system; infected files will be automatically rejected.
- (c) Attempt to gain unauthorized access to any portion of the Platform, other users’ accounts, or systems connected to the Platform.
- (d) Use the Platform to send unsolicited communications (spam) through the sharing or collaboration features.
- (e) Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Platform.
- (f) Use the Platform in any manner that could disable, overburden, or impair its performance.
- (g) Use automated scripts, bots, or other means to access the Platform in a manner not authorized by us.
- (h) Circumvent or disable any security features of the Platform.
3. Your Content
- 3.1. You retain all rights to the documents, files, and content you upload to the Platform (“Your Content”). We do not claim any ownership over Your Content.
- 3.2. By uploading content, you grant us a limited, non-exclusive license to store, process, convert, display, and transmit Your Content solely for the purpose of providing the Platform services to you and your organization.
- 3.3. We will never use Your Content to train AI models, sell to third parties, or for any purpose other than providing the Platform services. This commitment survives termination of your account.
- 3.4. You are responsible for ensuring that Your Content does not infringe the intellectual property rights of any third party and complies with all applicable laws.
4. Intellectual Property
- 4.1. The Platform, including all software, design, branding, documentation, and related materials, is the exclusive property of Maskan Technologies Private Limited and is protected by applicable intellectual property laws.
- 4.2. These Terms do not grant you any rights to our trademarks, service marks, logos, or brand elements.
5. Privacy
Your use of the Platform is also governed by our Privacy Policy, available at /privacy-policy. Please review it carefully to understand how we collect, use, and protect your personal data.
6. Platform Availability
- 6.1. We use commercially reasonable efforts to maintain the availability of the Platform, but we do not guarantee uninterrupted or error-free operation.
- 6.2. We may perform scheduled maintenance from time to time, during which the Platform may be temporarily unavailable. We will endeavour to provide advance notice of planned maintenance.
7. Limitation of Liability
- 7.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
- 7.2. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOUR ORGANIZATION DURING THE TWELVE MONTHS PRECEDING THE CLAIM.
8. Termination
- 8.1. Your organization’s administrator may deactivate your account at any time.
- 8.2. We may suspend or terminate your access if you violate these Terms, pending investigation and resolution.
- 8.3. Upon termination, your access to the Platform will cease. Data retention and deletion are governed by the MSA between us and your organization and our Privacy Policy.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through a notice on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates.
